CRS Report Released: Environmental Regulation and Agriculture

The Congressional Research Service (CRS), the public policy research arm of Congress, recently issued the report Environmental Regulation and Agriculture (Feb. 22, 2013). The 51-page report authored by Megan Stubbs discusses the following:

Summary


As the U.S. and global economies continue to struggle, some inside and outside of Congress have expressed concern about how environmental regulation may stifle growth and productivity. Much of the criticism has focused on environmental regulations promulgated by the Environmental Protection Agency (EPA). Some claim that EPA is overreaching its regulatory authority and imposing costly and burdensome requirements on society. In general, the agriculture community, among others, has been vocal in its concerns, contending that EPA appears to be focusing some of its recent regulatory efforts on agriculture. Many public health and environmental advocates, on the other hand, support many of EPA’s overall regulatory efforts and in some cases argue that EPA has not taken adequate action to control the impacts of certain agricultural activities. Where agriculture contributes to environmental impairment, these groups say, it is appropriate to consider ways to minimize or eliminate the adverse impacts.
Growing interest in the impact of regulatory actions on many sectors of the economy is evident in Congress, which continues to examine the role of EPA and other federal agencies in regulating environmental protection. Congress has a number of policy options to address or respond to potential regulatory impacts
Most environmental regulations, in terms of permitting, inspection and enforcement, are implemented by state and local governments, often based on federal EPA regulatory guidance. In some cases, agriculture is the direct or primary focus of the regulatory actions. In other cases, agriculture is one of many affected sectors. Traditionally, farm and ranch operations have been exempt or excluded from many environmental regulations. Given the agricultural sector’s size and its potential to affect its surrounding environment, there is interest in both managing potential impacts of agricultural actions on the environment and also maintaining an economically viable agricultural industry. Of particular interest to agriculture are a number of regulatory actions affecting air, water, energy, and chemicals.
Air
Agricultural production practices from both livestock and crop operations generate a variety of substances that enter the atmosphere, potentially creating health and environmental issues. Recent actions by EPA to regulate emissions and pollutants have drawn criticism, including greenhouse gas emission reporting and permitting requirements, and National Ambient Air Quality Standards (NAAQS) related to particulate matter (commonly referred to as dust). The agricultural community continues to show particular interest in NAAQS because some farming and livestock practices contribute to particulate matter emissions.
Water
Water quality issues also are of interest to the agricultural industry. Water is an input for production and can also be degraded as a result of production through the potential release of sediment, nutrients, pathogens, and pesticides. The extent and magnitude of water quality degradation from agriculture practices varies greatly, but agriculture is proven to be a significant source of impairment of several U.S. waters. Federal environmental laws largely do not regulate agricultural actors, in many cases giving the regulatory responsibilities to the states. One exception is large concentrated animal feeding operations (CAFOs), which are subject to permitting requirements. Constraints on agricultural production to reduce pollution discharges typically arise at the state level in response to local concerns, and how to manage agricultural sources has been a prominent issue in several large watershed restoration efforts, such as those in the Chesapeake Bay and Florida Everglades.
Energy
Changes in energy policy, namely increased bioenergy production, have recently become important to many in the agricultural industry, based on the potential of corn-based biofuel production to contribute to the nation’s energy supply through both the renewable fuel standard (RFS) and the increased percentage of ethanol in gasoline (E15).
Chemicals
Hundreds of chemical products are available to repel or kill “pests” that affect agricultural production. The federal regulation of these chemicals includes registering and restricting their use. The risks associated with agricultural chemical use and possible impacts on human health and the environment also have led to recent federal regulatory reviews of chemical fertilizer and pesticide use.

CRS Report Released: Is Biopower Carbon Neutral?

The Congressional Research Service (CRS), the public policy research arm of Congress, recently issued the report Is Biopower Carbon Neutral? (Jan. 2, 2012). The 18-page report authored by Kelso Bracmort discusses the following:

Summary

Congress has expressed interest in biopower—electricity generated from biomass. Biopower, a baseload power source, has the potential to strengthen rural economies, enhance energy security, and improve the environment, proponents say. Biopower could be produced from a large range of biomass feedstocks nationwide (e.g., urban, agricultural, and forestry wastes and residues). One challenge to biopower production is a readily available feedstock supply. At present, biopower requires tax incentives to be competitive with conventional fossil fuels. If Congress considers a renewable electricity standard or other measures (e.g., farm bill energy programs) that include biopower, there may be concerns about the carbon neutrality of biopower. Congressional support for biopower has aimed to promote energy diversity and improve energy security, and has generally assumed that biopower is carbon neutral. An energy production activity is typically classified as carbon neutral if it produces no net increase in greenhouse gas (GHG) emissions on a life-cycle basis. The premise that biopower is carbon neutral has come under scrutiny as its potential to help meet U.S. energy demands and reduce U.S. greenhouse gas emissions is more closely examined.
Whether biopower is carbon neutral depends on many factors, including the definition of carbon neutrality, the feedstock type, the technology used, and the time frame examined. Carbon flux (emission and sequestration) varies at each phase of the biopower pathway, given site- and operation-specific factors. A life-cycle assessment (LCA) is a common technique to calculate the environmental footprint, including the carbon flux, of a particular biopower pathway. However, past legislation has not required a standardized LCA.
Interest in the carbon classification of biopower is in part due to sustainability and air quality concerns. Where the feedstock supply for biopower originates, if it is managed in a sustainable manner, and whether the associated air quality impacts from biopower generation are tolerable are questions that are part of the biopower carbon-neutrality debate. Congress may decide whether the current carbon-neutral designation for biopower is accurate, or whether additional carbon accounting for biopower is warranted and what impact this accounting might have on renewable energy, agricultural, and environmental legislative goals.
Rulings by the U.S. Environmental Protection Agency have raised questions about the carbon neutrality of biopower. For instance, the 2010 Prevention of Significant Deterioration and Title V Greenhouse Gas Tailoring Rule did not exempt emissions from biomass combustion. Some view EPA’s decision as equating biomass emissions with fossil fuel emissions. EPA decided in 2011 to defer for three years GHG permitting requirements for carbon dioxide emissions from bioenergy and other biogenic stationary sources in order to conduct a detailed examination of the science associated with these emissions. EPA’s Scientific Advisory Board conducted an independent review of the agency’s biogenic accounting framework and released its findings in September 2012. The board acknowledged the “daunting task” of assessing the greenhouse gas implications of bioenergy, and the “narrow regulatory boundaries” within EPA’s purview that limit the consideration of greenhouse gas flux at various points along the bioenergy pathway.
State perspectives on the tailoring rule are divided. Some states contend that treating biomass combustion the same as fossil fuel combustion will result in excessive permitting requirements and fees that jeopardize renewable energy development. Other states argue that not treating it the same will aggravate climate change over time.

National Academies Report Released: Sustainable Development of Algal Biofuels

Recently, the National Academies Press (NAP) released a report produced by the Committee on the Sustainable Development of Algal Biofuels; Board on Agriculture and Natural Resources; Board on Energy and Environmental Systems; Division on Earth and Life Studies; Division on Engineering and Physical Sciences; and the National Research Council titled, Sustainable Development of Algal Biofuels (2012). The 231-page report is available here, free with a one-time registration. According to the abstract,
Biofuels made from algae are gaining attention as a domestic source of renewable fuel. However, with current technologies, scaling up production of algal biofuels to meet even 5 percent of U.S. transportation fuel needs could create unsustainable demands for energy, water, and nutrient resources. Continued research and development could yield innovations to address these challenges, but determining if algal biofuel is a viable fuel alternative will involve comparing the environmental, economic and social impacts of algal biofuel production and use to those associated with petroleum-based fuels and other fuel sources. This report was produced at the request of the U.S. Department of Energy.

U.S. Energy Information Administration Report Released: Biofuels and Trends

Recently, the U.S. Energy Information Administration (EIA) released a report titled, Biofuels and Trends (2012). The 48-page report available here, was released on Oct. 15, 2012. Highlights for this report include the following:


  • Ethanol grew from 8 percent of U.S. gasoline consumption by volume in 2009 to nearly 10 percent in 2011 and in the first eight months of 2012. With almost all gasoline in the United States already blended with 10 percent ethanol (E10), the maximum level approved for use in all cars and light trucks, significant increases in domestic consumption of ethanol face a blend wall unless higher percentage ethanol blends can achieve significant market penetration.
  • While the U.S. Environmental Protection Agency (EPA) has approved use of a 15 percent ethanol blend (E15) for model year 2001 and newer cars and light trucks, concerns related to automobile warranties, potential liability for misfueling, and infrastructure costs are likely to limit E15 use to low volumes in the near term.
  • Exports of ethanol increased substantially as producers looked abroad for new markets and Brazil experienced a poor sugar harvest during 2011-12.
  • In the 2010/11 agricultural marketing year, 40 percent of the corn crop and 14 percent of soybean oil production was used to produce biofuels and other products, including distillers grains for use as animal feed.
  • The federal excise tax credits for non-cellulosic ethanol and biodiesel and the ethanol import tariff expired at the end of 2011.
  • A serious drought in the midwestern United States during summer 2012 lowered production estimates for corn and other crops, resulting in higher prices and a reduced forecast for biofuels production for the 2012/13 marketing year.
  • Plans for a pipeline to deliver ethanol from the Midwest to the Northeast were withdrawn during 2011.
  • Cellulosic biofuels production to date is far below the targets set by the Energy Independence and Security Act of 2007 (EISA 2007). EPA issued waivers that substantially reduced the cellulosic biofuels obligation under RFS2 for the 2010, 2011, and 2012 program years. Even that anticipated level of commercial production failed to materialize. There was no production of cellulosic biofuels or Renewable Identification Numbers (RINs) in 2010 or 2011. While a small number of cellulosic RINs may be available to be applied towards the reduced RFS2 requirements for 2012 set under EPA's waiver, production of cellulosic biofuel RINs in 2012 is likely to be well short of the reduced 2012 requirement. Biofuel Economics in a Setting of Multiple Objectives & Unintended Consequences a study by William Jaeger of Oregon State University argues:

From the abstract:
"This paper examines biofuels from an economic perspective and evaluates the merits of promoting biofuel production in the context of the policies’ multiple objectives, life-cycle implications, pecuniary externalities, and other unintended consequences. The policy goals most often cited are to reduce fossil fuel use and to lower greenhouse gas emissions. But the presence of multiple objectives and various indirect effects complicates normative evaluation.

To address some of these complicating factors, we look at a several combinations of policy alternatives that achieve the same set of incremental gains along the two primary targeted policy dimensions, making it possible to compare the costs and cost-effectiveness of each combination of policies. For example, when this approach is applied to U.S.-produced biofuels, they are found to be 14 to 31 times as costly as alternatives like raising the gas tax or promoting energy efficiency improvements.

The analysis also finds the scale of the potential contributions of biofuels to be extremely small in both the U.S. and EU. Mandated U.S. corn ethanol production for 2025 reduces U.S. petroleum input use by 1.75%, and would have negligible net effects on CO2 emissions; and although EU imports of Brazilian ethanol may look better given the high costs of other alternatives, this option is equivalent, at most, to a 1.20% reduction in EU gasoline consumption.

The U.S. Department of Energy's Biomass Program is hosting a webinar on Tuesday, May 17, 2011, from 11:00 a.m. to 12:30 p.m. EDT, entitled "Sustainability for the Global Biofuels Industry: Minimizing Risks and Maximizing Opportunities." This Web conference is the next installment in the Biomass Program's webinar series, which will cover many of the Program's activities and feature discussions on "Hot Topics" relevant to the development of renewable fuels, power, and products from biomass resources.

This webinar will feature an overview of sustainability issues related to the development of a global biofuels market. Photosynthesis for Hydrogen and Fuels Production -- Webinar

Dr. Tasios Melis of UC Berkeley, a pre-eminent researcher in the field of Photobiological Hydrogen Production, will be providing an overview of his invention disclosing methods and compositions to minimize the chlorophyll antenna size of photosynthesis by decreasing the expression of the novel TLA1 gene, thereby improving solar conversion efficiencies and photosynthetic productivity in plants and algae.

Photobiological generation of hydrogen, fuels, and synthetic chemistry feedstock requires maximal energy conversion efficiencies in photosynthesis. Improvements by up to 300% in solar energy conversion efficiency and photosynthetic productivity can be achieved in plants and algae upon minimizing, or truncating, the chlorophyll antenna size of the photosynthetic apparatus. Methods to minimize the chlorophyll antenna size of photosynthesis by decreasing the expression of the novel TLA1 gene were developed, enabling improved solar conversion efficiencies and photosynthetic productivity. This new invention and enabling technology has broad positive implications for mass culture productivity. A truncated light-harvesting chlorophyll antenna size (TLA1 gene suppression), in various classes of photosynthetic organisms, helps to alleviate excess absorption of sunlight and the ensuing shading and wasteful dissipation of excitation energy. It improves sunlight penetration and maximizes solar-to-product energy conversion efficiency in high-density mass cultures. The TLA1 gene suppression concept may thus find application in the commercial exploitation of microalgae and plants for the generation of hydrogen, biofuels, biomass, chemical feedstock, as well as nutraceuticals and pharmaceuticals.

EPA Finalizes 2011 Renewable Fuel

Under the Clean Air Act Section 211(o), the Environmental Protection Agency (EPA) is required to set renewable fuel standards each November for the following year based on gasoline and diesel projections from the Energy Information Administration (EIA).

The EPA is also required to set the cellulosic biofuel standard each year based on the volume projected to be available during the following year, using EIA projections and assessments of production capability from industry. This regulatory action finalizes these annual standards for cellulosic, biomass-based diesel, advanced biofuel, and total renewable fuels that apply to all gasoline and diesel produced or imported in year 2011.

The final rule also presents two changes to the RFS2 regulations. The first modifies the provision for “delayed RINs” to make it more broadly applicable to any biofuel production pathway so long as the biofuel was in commercial production on July 1, 2010.

The second regulatory provision being finalized in this rulemaking establishes criteria for the EPA to use in determining whether to approve petitions for foreign-grown feedstocks so that they may use an aggregate approach to comply with the renewable biomass verification provisions, akin to that applicable to producers using crops and crop residue grown in the United States.

Advanced Biofuels Research Pathways -- Webinar

The U.S. Department of Energy's (DOE's) Biomass Program is hosting a Webinar on Thursday, November 18, 2010, from 3:00-4:30 p.m. EST.

This Web conference is the second installment in the Biomass Program's Webinar series, which will cover many of the program's activities and feature "Hot Topics" discussions relevant to the development of renewable fuels, power, and products from biomass resources.

The Webinar will feature an overview of the program's ongoing advanced biofuels research and will include presentations on biochemical and thermochemical conversions. This session will also discuss the progress the National Advanced Biofuels Consortium (NABC) is making in research, development, and demonstration of process technology strategies to convert biomass feedstock into a form that can be used in a petroleum refinery. These new and innovative approaches can advance the commercialization and adoption of advanced biofuels.

A USDA Regional Roadmap to Meeting the Biofuels Goals of the Renewable Fuels Standard by 2022

This USDA Biofuels Strategic Production Report, dated June 23, 2010 is intended to start compiling real world data that would indicate the size and scope of the investments necessary to achieve 36 billion gallons of renewable biofuels by 2022.

What USDA has shown in this report is:
(1) A rapid build-up in production capabilities is needed to meet the RFS2 targets for cellulosic biofuels.
(2) The scope of the monetary investment for biorefineries is substantial.
(3) It is important to consider both sides of the market – the production/supply side and mandate/consumption side – and how they respond to the RFS2 mandate.
(4) There are current infrastructure needs, in the form of blender pumps and rail and trucking infrastructure which are in varying stages of being addressed by the market, though a careful assessment of barriers to their development is needed.
(5) The U.S. farm sector is capable of producing a diverse complement of feedstocks to make the biofuels industry a truly national effort.
(6) In addition, a process for identifying bottlenecks and barriers related to locating biorefineries involving the federal government, Congress, states, the industry and interested stakeholders can help facilitate a biorefinery system that is national in scope.

Using Biofuel Tax Credits to Achieve Energy and Environmental Policy Goals

This congressional Budget Office Report Dated July 2010 assesses the incentives provided by the biofuel tax credits for producing different types of biofuels and analyzes whether they favor one type of biofuel over others. In addition, the study estimates the cost to U.S. taxpayers of reducing the use of petroleum fuels and emissions of greenhouse gases through those tax credits; it also analyzes the interaction of the credits and the biofuel mandates. In keeping with CBO’s mandate to provide objective, impartial analysis, the study contains no recommendations.

Energy-Water Nexus: Many Uncertainties Remain about National and Regional Effects of Increased Use of Biofuel Production on Waer Resources

This Government Accountability Office Report (GAO 10-116) dated November 2009 finds that the extent to which increased biofuels production will affect the nation’s water resources depends on the type of feedstock selected and how and where it is grown. For example, to the extent that this increase is met from the cultivation of conventional feedstocks, such as corn, it could have greater water resource impacts than if the increase is met by next generation feedstocks, such as perennial grasses and woody biomass, according to experts and officials.

Energy and Water: Preliminary Observations on the Lnks Between and Biofuels and Electricity Production

This Government Accountability Office testimony dated July 9, 2009 (GAO-09-862T) explains that the effects of producing corn-based ethanol on water supply and water
quality are fairly well understood, less is known about the effects of the next
generation of biofuel feedstocks.

Water usage in the corn-based ethanol conversion process has been declining and is currently estimated at 3 gallons of water per gallon of ethanol, the amount of water consumed in the conversion of cellulosic feedstocks is less defined and will depend on the process and on technological advancements that improve the efficiency with
which water is used.

Biofuel Policies and Programs

This Report by the Minnesota Office of the Legislative Auditor finds that traditional biofuels like corn-based ethanol and soy-based biodiesel serve a useful purpose. However, land constraints and economic considerations limit the extent to which traditional biofuels can replace petroleum-based fuels. Cellulosic ethanol appears to have significant environmental and energy advantages over corn-based ethanol, but questions remain about its economic viability and its potential land use and environmental impacts.

Increasing Feedstock Production for Biofuels: Economic Drivers, Environmental Implications, and the Role of Research

This Report from the interagency Biomass Research and Development Board on the economic feasibility of developing both farm- and forest-derived biofuel feedstocks to meet national targets for biofuels to reduce gasoline consumption.

Among the report's overall conclusions is that new technologies resulting from research and development are the linchpin to developing a sustainable biofuel industry that meets national targets. Last year's energy bill set out a Renewable Fuels Standard that calls for production of 36 billion gallons of biofuels annually by 2022.
